FTC "Apparently" Delays Vote on Final Rule Banning Most Non-Compete Agreements Nationwide

On January 5, 2023, the Federal Trade Commission (“FTC”) issued a proposed new rule banning non-compete agreements. The proposed rule sought not only a ban of future non-compete agreements, but also required rescission of existing agreements. The FTC sought public comment for sixty days on the proposed rule before modifying the rule or issuing a final rule.

After the FTC extended the comment period until April 19, 2023, Bloomberg Law has now reported that the FTC’s vote to formally ban most non-compete agreements throughout the United States will not take place until April of 2024.
